Physionex Terms of Service

These Terms of Service govern access to and use of Physionex applications, websites, workspaces, and related services provided by Physionex Labs LLC.

Eligibility and accounts

You must be legally able to enter these Terms and meet the minimum age required where you live. You are responsible for accurate account information, protecting your credentials, and activity performed through your account.

One Physionex identity may access Personal, Coach, and Gym workspaces with different permissions, relationships, and subscription requirements.

Fitness and health disclaimer

Physionex provides fitness, nutrition-planning, organization, communication, tracking, and AI-assisted tools. Physionex does not provide medical diagnosis, emergency care, or individualized medical treatment.

Consult an appropriately qualified healthcare professional before beginning or materially changing an exercise or nutrition program when appropriate, especially if you have an injury, medical condition, pregnancy, medication concern, or unusual symptoms. Stop activity and seek appropriate care when warning signs occur.

Coaches and gyms

Coaches and gyms using Physionex are independent users or organizations unless Physionex expressly states otherwise. They are responsible for their own services, credentials, advice, staffing, client relationships, legal compliance, and use of workspace information.

Acceptable use

You may not misuse Physionex, access another person's account without authorization, misrepresent your identity or qualifications, upload unlawful or harmful material, interfere with security, bypass product limits, harass or endanger others, or use Physionex in violation of applicable law.

User content

You retain ownership of content you submit. You grant Physionex a limited license to host, process, transmit, display, transform, and back up that content as necessary to operate, secure, and provide the service.

When you share information with a coach, client, gym, or workspace team, you authorize access according to the selected relationship and permissions.

AI-assisted content

AI-generated output may be inaccurate, incomplete, inconsistent, or unsuitable. Users and coaches are responsible for reviewing generated content before relying on or assigning it. AI functionality does not replace professional judgment or medical care. See the AI Disclosure.

Subscriptions and payments

Paid functionality may be purchased through Apple, Google, or another authorized billing channel. Pricing, renewal periods, trials, cancellations, refunds, upgrades, downgrades, and purchase restoration are subject to the offering displayed before purchase, applicable store rules, and our Subscription Terms.

Intellectual property

The Physionex software, branding, design, documentation, and service content, excluding user-owned content, are owned by Physionex Labs LLC or its licensors and are protected by applicable intellectual-property laws.

Suspension and termination

Physionex may restrict, suspend, or terminate access when reasonably necessary because of violations of these Terms, fraud, security threats, nonpayment, applicable legal requirements, or material risk to users or the service.

Service availability and changes

Features may evolve, be limited, or be discontinued. We may perform maintenance and cannot guarantee uninterrupted availability. Physionex is not an emergency or medical-response service.

Disclaimer of warranties

To the maximum extent permitted by applicable law, Physionex is provided “as is” and “as available.” We disclaim implied warranties to the extent those warranties may legally be disclaimed.

Limitation of liability

To the maximum extent permitted by applicable law, Physionex Labs LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service. Nothing in these Terms limits rights or liability that applicable law does not permit us to exclude.

Governing law

To the extent permitted by applicable law, these Terms are governed by the laws of the State of Ohio and applicable United States law, without regard to conflict-of-law principles. Mandatory consumer protections applicable where you live remain unaffected.

Changes

We may update these Terms as Physionex evolves. Material changes will be communicated when required by applicable law.
